The present Terms & Conditions regulate the online e-commerce contract, celebrated through this website www.bavashdesigns.com operated by the company Casa Florida, Sociedade Unipessoal, Lda., based at Rua Felizardo Lima, Nº 185 4100-238 Porto, Portugal, with Tax Number 506.250.865, as Trader (hereon, Bavash Designs), and the Buyer, that should purchase any product or service.

1. ONLINE STORE TERMS:
By purchasing products or services from our site ( www.bavashdesigns.com), the Buyer agrees to these Terms of Service.
2. SERVICE AND PRICES:
– Prices of our products correspond to the current prices during the buying process and include VAT, at the legal rate in force in Portugal.
The price of the product will be added to by a shipping fee.
Prices for our products are subject to change without notice.
3. PRODUCT AVAILABILITY:
3.1. – Our online store on our site www.bavashdesigns.com is designed for the client to have anticipated information, on the availability of the product. Nevertheless, Bavash Designs will not take responsibility for the inexistence, at some time or other, of certain products, so if for this reason the transaction should not be possible Bavash Designs will not be held, at any moment, responsible towards the client for any damage or loss endured by the client, with the only exception clearly expressed contrarily in these Terms & Conditions.
3.2. – In such cases in which the shipping of the product bought by the Client should not be possible for Bavash Designs within 10 days, Bavash Designs will credit the Client for the amount spent, using the same payment method as the Client.
3.3. – Certain products or services may be available exclusively online through the website, as they may exist in limited quantities. These products or services will be subject to return or exchange only according to our Return Policy.
4. PRODUCTS OR SERVICES:
4.1 – Products are described and displayed as accurately as possible, respecting their original characteristics. Nevertheless, Bavash Designs will not be held responsible for the inexistence of characteristics that are not explicitly included in the individual description of each product.
4.2 – Without prejudice to the previous point, products offered for sale on the site Bavash Designs may not correspond exactly to real appearance either in image or color. We cannot guarantee that your computer monitor’s display or internet navigator in use will be accurate.
4.3 – Bavash Designs does not sell second hand products, with flaws or inferior quality to that of the existing models on the market. All products have an identifying tag, which should not be removed in order for an exchange/return procedure to be allowed.
5. ORDERS AND PAYMENT:
The available payment methods are announced on the website www.bavashdesigns.com and can vary according to the product chosen by the Client, his place of residence and the chosen and/or available delivery system.
6. PRODUCT DELIVERY
All purchases made online will be delivered at the address indicated by the Client, when filling in the customer account. The Client agrees to provide current, complete and accurate information for all purchases made at the website www.bavashdesigns.com. Bavash Designs will not be held responsible for any inexact information provided by the Client, or due to any other cause for which it is not chiefly and directly attributable for and that results as an impediment to the correct and timely delivery of the product ordered by the Client.
The delivery of the products implies previous or simultaneous payment of these same products at their indicated price, as well as costs due to shipping and/or delivery.
Deliveries are made in the terms defined by the shipping company. Bavash Designs will take no responsibility concerning shipping and delivery issues of products to the Client.
Shipping will take place within 3 (three) working days after the order has been processed on the website and payment has been confirmed. The delivery date will vary according to destination and chosen shipping method.
7. RIGHT TO FREE RESOLUTION
If for any reason, the Client should not be satisfied with the product that was ordered, he/she is allowed to proceed so as return the product, within 14 (fourteen) working days of its receipt, according to our Return Policy.
8. APPLICABLE LAW AND COMPETENCE:
8.1. – To all questions related to the present Terms & Conditions, Portuguese Law is applied.
8.2. – In order to clarify any emerging litigation from the present contract, it is agreed to refer to the District of Porto, with express waiver of any other.
